Disciplinary rules
n many professional groups (medicine, psychology, psychiatry, the legal profession, the notarial profession, accountancy, etc.) there is some form of disciplinary rules. Our department regularly represents professionals brought before a disciplinary court. We often represent the claimants themselves as well.
A professional practitioner usually finds a complaint very distressing. He finds that his good reputation and name are tarnished, and is not comfortable having his actions judged by his colleagues either. Their ample experience makes the lawyers of this department exceptionally qualified to represent you. In addition to that, disciplinary rules come with their own set of ethics, which makes the experience of our department with disciplinary rules a definite advantage.
Corporate law
GeneralThe (advisory) activities of Ms Du Bois are predominantly focused on corporate law issues. Examples include the drawing up or assessment of contracts and general terms and conditions, but also conflicts concerning agency agreements and such. This makes her the one to turn to in our office for assistance and advice in this regard, but all the public law lawyers of our office regularly represent entrepreneurs in various proceedings.
Trade with and in ChinaAlice Hsu Esq. is an American lawyer of Chinese descent and is not only fluent in English and French, but in Mandarin as well. She has clients in China, Europe and the United States. If you do business with the US of China, or wish to do business with or in those countries, she is more than happy to be of service to you. She has offices in China and the US as well.
Employment lawWhen it comes to employment law, our department represents both employers and employees. Lawyers of our department have drawn up the employment conditions of several companies. On various occasions, our office successfully represented employees as well. We have acted on behalf of and taken action against both Dutch companies and international organisations.
Sports law
Catelijne Vilé has graduated in the field of sports law. She successfully represents, among others, sports federations and individual athletes with regard to their legal problems on a regular basis.
Insolvency
WSNPWSNP is short for Wet Schuldsaneringsregeling Natuurlijke Personen (the Dutch Debt Rescheduling (Natural Persons) Act) More information on this can be found on www.wsnp.rvr.org.
Our department has ample experience in this field. You can apply to become subject to the WSNP through the Court. However, your application may be rejected. You may also be “thrown out” of the WSNP, and/or cancellation of the debts may be refused. In those cases, you can appeal.
The time limits in WSNP cases are extremely short. Therefore, if you wish to appeal, you must contact us as soon as possible. In addition to persons subject to a debt rescheduling arrangement (those who rely upon the WSNP), our department regularly represents administrators as well.
Richard A. Korver is regularly asked to give lectures on this subject, both for administrators and debt counsellors and for companies and government agencies.
Compulsory arrangements
Our department regularly represents both creditors and debtors in situations in which it has come to a compulsory arrangement. A compulsory arrangement is an arrangement offered to the creditors of a person faced with serious financial problems. The creditors are offered a percentage of their claim in full and final settlement.
If the offered settlement meets the requirements prescribed by law and case law and a minority of the creditors refuse to cooperate, their cooperation can be enforced through legal proceedings.
To that end, it is often advised to institute Interlocutory Proceedings. In such cases, it is important that you have your correspondence in order. The legislation on compulsory settlement last changed on 1 January 2008. Richard A. Korver is regularly asked to give lectures on this subject as well, both for administrators and debt counsellors and for companies.
Family and Juvenile law
As you may have heard in the news, the situation in the world of youth services is dire. Unfortunately, family supervision orders (ondertoezichtstelling – OTS) and custodial placements (uithuisplaatsingen – UHP) are an every-day occurrence. Mr Korver, Ms Du Bois and Ms Hendriks regularly represent minors and their parents in such situations.
If the Child Care and Protection Board (Raad voor de Kinderbescherming) and/or the Youth Care Agency (Bureau Jeugdzorg) have acted unlawfully, the lawyers of Korver & Van Essen do not hesitate to bring this to light.
In addition to specific cases that involve minors, Ms Du Bois and Ms Hendriks in particular also represent private individuals in divorce cases, maintenance disputes and other issues concerning Law of Persons and Family Law.
Landlord and tenant lawMs Du Bois predominantly handles landlord and tenant law cases. Ms Hendriks regularly represents expats faced with housing problems.
Victims
If you are the victim of a crime or a wrongful act committed by a person, company or other party, you can turn to us as well. We can represent you both in criminal and civil proceedings.
Victims of sexual crimesRichard A. Korver is a co-founder of the National Lawyers Network Vice Victims (Landelijk Advocaten Netwerk Zeden Slachtoffers) and a board member of the Test Case Fund Clara Wichmann (Proefprocessenfonds Clara Wichmann). As such, he knows all about the problems faced by victims of sexual crimes in particular. Along with Anneliek Hendriks, he regularly represents victims of sexual crimes. They not only represent victims in actions for damages through a claim as the injured party within the meaning of the Dutch Penal Code, but also in actions for damages through civil proceedings (with the Civil Court) and through the Criminal Injuries Compensation Fund (Schadefonds Geweldsmisdrijven).
Quite often, the victims do not want to be confronted with the offender in their daily life. In such cases, we will try to get them a non-molestation order and/or street injunction through Interlocutory Proceedings. Sometimes, sexual crimes are committed in the work place, resulting in an employment conflict. We can represent you in such cases as well.
Richard A. Korver regularly provides courses and workshops and gives lectures on the representation of victims of sexual crimes.
